PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Revision Case has been filed under Sections 397 & 401 of Criminal Procedure Code (for brevity ‘the Cr.P.C.’) seeking to challenge the docket order, dated 05.06.2025 passed in P.R.C. No.6 of 2022 on the file of Chief Metropolitan Magistrate, Vijayawada. 2 2. Heard the learned counsel for the petitioners and learned Assistant Public Prosecutor for the State. 3. The learned Single Judge of this Court, in Crl.P. No. 2929 of 2025, on 19.03.2025, granted stay of all further proceedings in P.R.C. No. 6 of 2022, on the file of the Chief Metropolitan Magistrate, Vijayawada. The stay was subsequently extended from time to time. During the operation of the stay, the learned Chief Metropolitan Magistrate, Vijayawada, issued NBWs against accused Nos. 1 and 2 on 05.06.2025. When the petitioners filed an application seeking cancellation of the NBWs issued against them, the learned Chief Metropolitan Magistrate allegedly returned the application on the ground that the stay was still in operation. The learned Chief Metropolitan Magistrate , Vijayawada ought to have exercised restraint in issuing NBWs while the stay was in effect. 4. Considering the facts and circumstances of the case, the Criminal Revision Case is allowed by cancelling the NBWs issued by the Chief Metropolitan Magistrate, Vijayawada in P.R.C. No. 6 of 2022, dated 05.06.2025. The petitioners are directed to appear before the learned Chief Metropolitan Magistrate, Vijayawada in P.R.C. No. 6 of 2022, as and when required. 5.
