ORDER: The instant petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 is filed on behalf of the Petitioner /A.3 seeking to grant anticipatory bail to him in connection with Crime No.279 of 2024 on the file of Vizianagaram ll Town Police Station.
2. Heard Ms.T.V.Sridevi, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Publ-lc Prosecutor for the Respondent/State. + '3>
2 3, Learned counsel for the Petitioner/Accused would submit that the Petitioner is falsely implicated in the present case based on the confession of the Accused No.1. Learned counsel would further submit that, no contraband has been seized from the possession of the Petitioner and there are no ingredients to attract the alleged offences against the Petitioner.
Learned counsel would submit that the Petitioner has nothing to do with the present crime. lt is submitted that the Petitioner is ready to furnish sureties to the satisfaction of the Court.
4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders.
5. Considering the submissions made and on perusal of the material on record, the fact remains is that, base on the confession of the co-accused, the Petitioner is arrayed as an Accused in the present crime. As put by the
learned counsel for the Petitioner, the alleged contraband seized from Accused Nos.1 and 2 is 53.5 gms and 53 gms respectively and there was no seizure of property from the Petitioner/Accused No.3. Further, it is not the stage to decide the culpability of the Petitioner by accepting the allegations leveled against him. As such, this Court is inclined to grant anticipatory bail to the Petitioner.
6. Accordingly, the petition is allowed granting anticipatory bail to the Petitioner herein, on the following conditions: (i) The Petitioner /A.3 shall appear before the concerned Magistrate Court, within 15 days from today and shall furnish a personal bond for c±-= ,=
3 Rs.20,000/- (Rupees twenty thousand only) with two sureties for the like sum each, to the satisfaction of concerned Magistrate Court; (ii) The Petl'tioner shall be available for investigation as and when required by the Investigating Officer; (iii) The Petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the present case so as to dissuade him/her from disclosing such facts to the Court or to any Investigating or Police Officer. (iv) ln case of violation of any of the above conditions, the Prosecution is at liberty to take necessary steps for cancellation of the bail. Pending miscellaneous applications, if any, shall stand closed.
