6. Heard Sri K Ram Singh, learned counsel for the petitioner and Smt.Waheeda M.M, learned High Court Government Pleader for the respondent/State. 7. It is the submission of the learned counsel for the petitioner that the petitioner is innocent of the alleged offences and he has not committed any offences.
He is no way connected to the case of the prosecution and he has been falsely implicated on the strength of the statement of the co- accused. Even without any cogent evidence, he has been arrayed as an accused which is baseless and not relevant. 8. It is further stated that, the alleged incident stated to have taken place at Bengaluru, however, the petitioner is a resident of Belgaum. Similar relief has already been granted by the Trial Court to other accused persons, namely, accused No.1 and accused No.4 who are similarly placed. Therefore, the petitioner is also entitled to bail on the ground of parity. Making such submissions, the learned counsel for the petitioner prays to allow the petition. 9. the fake marks card racket. The manner in which they were deceiving innocent people by producing fake marks card clearly would indicate that they had knowledge and intention to commit the offence. Therefore, it is not appropriate to grant anticipatory bail to the petitioner. Making such submissions, she prays to dismiss the petition. 10. Having heard the learned counsel for the respective parties and also perused the averments of the complaint and also the other documents on record, it is noted that the petitioner has approached this Court seeking anticipatory bail. The name of the petitioner appears in the remand application on the strength of the statement of the co-accused. Obviously, the statement of the co-accused when he was in police custody, cannot be acceptable. 11. Having considered the above aspect, it is appropriate to grant anticipatory bail to the petitioner by imposing suitable conditions that would take care of the apprehension of the prosecution and also the investigating officer. 12. Hence, I proceed to pass the following:
