SUSHMA YAGANTI The Court made the following: ORDER Sri K.M.Krishna Reddy, learned counsel, representing Ms. Sushma Yaganti, learned counsel for respondent, submitted that, pursuant to the orders of this Court passed in W.P.No.2761 of 2024, disobedience of which is complained of in this Contempt Case, the No.ICD01/216/2022/LA, dated 04.12.2024 (LA), GNSS, Kadapa/ Special Deputy Collector (LA), Somasila Project, Unit C.C.No.3650 of 2024 1 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) MONDAY ,THE TENTH DAY OF FEBRUARY TWO THOUSAND AND TWENTY FIVE PRESENT THE HONOURABLE SRI JUSTICE RAVI CHEEMALAPATI CONTEMPT CASE NO: 3650/2024 Male Venkata Subbamma and Others ...PETITIONER(S) AND ...CONTEMNOR Counsel for the Petitioner(S): Counsel for the Contemnor: The Court made the following: Sri K.M.Krishna Reddy, learned counsel, representing Ms. Sushma Yaganti, learned counsel for respondent, submitted that, pursuant to the orders of this Court passed in W.P.No.2761 of 2024, disobedience of which is complained of in this Contempt Case, the respondent, issued Memo No.ICD01/216/2022/LA, dated 04.12.2024, directing the Special Collector (LA), GNSS, Kadapa/ Special Deputy Collector (LA), Somasila Project, Unit RC,J C.C.No.3650 of 2024 IN THE HIGH COURT OF ANDHRA PRADESH [3332] THE HONOURABLE SRI JUSTICE RAVI CHEEMALAPATI ...PETITIONER(S) ...CONTEMNOR Sri K.M.Krishna Reddy, learned counsel, representing Ms. Sushma Yaganti, learned counsel for respondent, submitted that, pursuant to the orders of this Court passed in W.P.No.2761 of 2024, disobedience of which is issued Memo the Special Collector (LA), GNSS, Kadapa/ Special Deputy Collector (LA), Somasila Project, Unit-IV, RC,J C.C.No.3650 of 2024 2 Rajampet, YSR District to implement the orders of the Court passed in W.P.No.39150 of 2014, dated 23.03.2017 relating to ReachNo.11 of Adurivaripalli village of Gopavaram Mandal of YSR District, subject to outcome of review, filed by the Special Deputy Collector (LA) SSP Unit-IV, Rajampet in WP No.39150 of 2014, dated 23.03.2017. By placing the said memo dated 04.12.2024, the learned counsel submitted that therefore, the order of this Court has been complied with, however with some delay, which is only due to the administrative reasons, but not due to any willful disobedience nor wanton. Hence, prayed to close the contempt. 2. In reply, learned counsel for the petitioner though contended that the said memo has not been furnished to him, however submitted that the contempt case may be closed, reserving liberty to the petitioner to assail the action of the authorities, if the amount, legally entitled to by the petitioners, is not paid. 3. The respondent-contemnor appeared virtually and submitted that the delay occurred in implementing the orders is neither willful nor wanton and the same occurred only due to administrative reasons and he tendered unconditional apology and undertook to be more vigilant in future. 4. In view of the above, considering the submissions made by the learned counsel for both the parties and also the contemnor, this Contempt Case is closed. It is left open to the petitioners to pursue the remedies RC,J C.C.No.3650 of 2024 3 available to him, if the respondent authorities did not pay him the legally entitled amount.
