Neutral Citation No. - 2025:AHC:40359 Court No. - 35 Case :- WRIT - C No. - 8066 of 2025 Petitioner :- Vakil Mohammad Respondent :- State Of U.P. And 23 Others Counsel for Petitioner :- Bhriguram Ji,Prabhat Kumar Counsel for Respondent :- C.S.C. Hon'ble Manish Kumar Nigam,J. 1. Heard learned counsel for the petitioner and perused the record. 2. This petition has been filed for the following relief: "Issue a writ order or direction in the nature of the certiorari quashing the impugned order dated 05/02/2025 (Annex 5) passed by the respondent no.2 in revision no 190/2025 Computer case No-C202507000000190 as well as order dated 10/01/2025 (Annex 3) passed by respondent no 3 in case no 2892/2024 computer case no- T202407320202892." 3. Contention of the learned counsel for the petitioner is that proceedings under Section 24 of U.P. Revenue Code, 2006 were initiated by respondent no. 4 in which the petitioner has filed objections which were rejected by order dated 10.01.2025. Against the order dated 10.01.2025, the petitioner filed a revision which has also been dismissed on 05.02.2025. 4. Learned Standing Counsel raised a preliminary objection that against an order passed under Section 24 of the U.P. Revenue Code, 2006, an appeal lies under Section 24(4) of U.P. Revenue Code, 2006 and instead of filing appeal, a revision has been filed by the petitioner which is not maintainable under Section 210 of the U.P. Revenue Code, 2006. 5. At this stage, learned counsel for the petitioner has submitted that he may be granted liberty to challenge the order passed under Section 24 of the U.P. Revenue Code, 2006 by filing an appeal under Section 24(4) of the U.P. Revenue Code, 2006. 6. Accordingly, the writ petition is disposed of with liberty to the petitioner to avail the remedy as available to him under law. 7. It is needless to say that the finding recorded by the revisional court will not come in way while deciding the appeal.
