Judgment On Board 24-04-2025 1) Learned counsel for the petitioners submits that suit filed by the petitioners for declaration of title and permanent injunction was filed along with application under Order 39 Rules 1 and 2 of CPC but the application was rejected by the learned trial Court vide order dated
27.03.2018. She further submits that appeal was preferred against that
order and same was dismissed vide order dated 15.04.2019. She contends that a direction may be issued to the learned trial Court to expedite the proceeding of the pending civil suit. 2) No objection from other side. 3) Taking into consideration the fact that suit was filed in the year 2017, learned trial Court is directed to expedite the trial and make all endeavours to conclude the proceeding at the earliest. 4) With the aforesaid direction(s), instant writ petition stands disposed of.
