1. GP FOR ENDOWMENTS (AP) The Court made the following: ORDER: The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“…..declaring the inaction of the respondent No.2 to 4 in allowing the self styled Dharma Sastra Bhakta Brundam committee members i.e. unofficial respondents No.5 to 9 to manage the Lord Ayyappa Temple (Sub temple of Sri Mahishasura Mardini Sametha Sri Kasi Visweswara Swamy Temple at Chemmanagiripeta, Machilipatnam) and collecting donations, misappropriation of funds of the temple as per the representation dated 09.11.2016 as well as not initiating Criminal Proceedings on the complaint dated 14.11.2015 is arbitrary and illegal and consequently issue directions to

the respondent No.3 not to allow the unofficial respondents to manage the temple and respondent No.4 to register the case and cause enquiry in the interest of justice and to pass such other order or orders…...”
2. None appeared for the petitioner. 3. Heard learned Assistant Government Pleader for Endowments, appearing for the respondents 1 and 2. 4. The 2nd respondent filed counter along with leave petition. While denying the contents of the writ petition, he stated that the private management people approached the Minister for Endowments requesting to stay the operation of the proceedings of the Deputy Commissioner of Endowments Department, Kakinada vide Rc.No.B4/2903/2016, dated 26.03.2016 in which single trustee was appointed to the 3rd respondent temple, accordingly the Hon’ble Minster for Endowments issued a note and stayed the operation of the said proceedings until further orders and submitted a detailed report for taking further action. Subsequently, a report has been submitted to the Commissioner of Endowments by the Deputy Commissioner of Endowments vide Rc.No.B4/2903/2016, dated 06.04.2016 and requested to appoint an Executive Officer to the subject temple to set right the temple administration and to safeguard the valuable properties of the temple.
But, no orders have been received from the Commissioner’s office in this regard and the private management called as Sri Dharma Sastra Bhakta Brundam is continuing in the management of Sri Ayyappa Swamy temple which is located in the premises of Sri Mahishasura Mardhini Sametha Sri Kasi Visweswara

Swamy Temple, Chemmanagiripeta, Machilipatnam, Krishna District. Further stated that in view of the stay granted by the Hon’ble Minister for Endowments on 14.02.2017, the appointment of single trustee issued by the Deputy Commissioner of Endowments is not in force and the aforesaid private management is continuing in the management of Sri Ayyappa Swamy temple which is located in the premises of Sri Kasi Visweswara Swamy Temple, Chemmanagiripeta, Machilipatnam. Therefore, sought for dismissal of the writ petition. 5. In view of the submissions made by the 2nd respondent in his counter, nothing survives in this writ petition for further adjudication. 6.
