Heard learned counsel for the petitioner and perused the material on record. 3. Though several contentions have been urged by the petitioner in support of his claim that the aforesaid petition filed by the respondent against him is not maintainable, having regard to the fact that the petitioner has already entered appearance in the aforesaid Criminal Miscellaneous No.200/2020 and has filed statement of objections and said proceedings are pending since 2020 and no interim order is passed in the present petition, - 3 - NC: 2025:KHC:13 CRL.P No. 7286 of 2023 without expressing any opinion on the merits and claim of the petitioner, I deem it just and appropriate to dispose of the petition reserving liberty in favour of the petitioner to urge all contentions in the aforesaid proceedings before the trial Court, who shall adjudicate upon the matter after providing sufficient and reasonable opportunity to both the parties and in accordance with law. 4.
