This is an application filed by the petitioners praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending their arrest for the offences under Sections 147, 148, 149, 341, 307, 504 and 506 of IPC and Section 27 of Arms Act and Section 17 of Criminal Law Amendments Act. The allegation against these petitioners is that they along with others attacked the house of this informant. They were armed with fire-arms and sticks. Learned counsel for the petitioners submits that there is no specific overt act against these petitioners and they were merely standing behind the house. After going through the facts and I find that the allegation against these petitioners is that they were also armed with weapon and standing with the others miscreants surrounding the informant’s house. Further from the impugned order, it is clear that notice under Section 41-A of the Cr.P.C. has been served upon them, but they did not appear. Considering the nature of allegation, I find that this is not a fit case for grant of anticipatory bail to the petitioners. Accordingly, the prayer for 2025:JHHC:11417 anticipatory bail of the petitioners in connection with Manika P.S. Case No.62 of 2022, pending in the court of learned Additional Chief Judicial Magistrate, Latehar stands rejected. (ANANDA SEN, J.) R.S./
