Ahmed, learned counsel for the petitioner. Also heard Mr. B. Sarma, learned Additional Public Prosecutor appearing for the State. This is an application under Section 482 of BNSS, 2023 praying for pre-arrest bail upon apprehension of the petitioner namely, Hanifur Rahman that he may be arrested in connection with Page No.# 2/2 a certain case, which had not been mentioned in the instant application. Accordingly, upon instruction received, it was revealed that Satgaon P.S. Case No. 158/2025 under Section 303(2)/318(4) BNS has been registered against the present petitioner. Case diary as called for has been received. It appears that the allegation against the petitioner that he is associated in a gang involved in cheating people at ATM by exchanging their ATM cards and withdrawing money. In the present case, a sum of Rs.40,000/- was withdrawn from the complainant’s account using his stolen ATM card. On perusal of the case diary, I find sufficient incriminating materials against the present petitioner, I am of the considered view that this is not a fit case for grating pre-arrest bail to the petitioner. Accordingly, the prayer stands rejected. Anticipatory bail application stands dismissed. Send back the case diary. JUDGE Comparing Assistant
