Order 13/05/2025
1. Instant civil writ petition under Article 226 of the Constitution of India has been filed by petitioner, feeling aggrieved by non
consideration of his candidature under General EWS category for appointment on the post of Pharmacist pursuant to advertisement dated 05.05.2023. 2. Petitioner has come up with a case that although he applied under Unreserved category for the post of Pharmacist, pursuant to the advertisement dated 05.05.2023, however later on, he made a Representation before respondents, to change his category from Unreserved to General EWS and submitted a caste certificate dated 15.07.2024, but his candidature has not been considered under the General EWS category. 3. Having heard the counsel for petitioner and after perusal of the record, it has transpired that in respect of validity of the caste
[2025:RJ-JP:20112] (2 of 2) [CW-12769/2024] certificate, there is a clear stipulation in advertisement dated 05.05.2023 itself, which reads as under:

4.
Indisputably, the petitioner wants to rely upon the caste certificate dated 15.07.2024, which is valid for the year 2024-25 and same is of no avail for the present Recruitment-2023, since as per the advertisement, the caste certificate of petitioner dated 15.07.2024 does not fall within the period, preceding one year from last cut off date of submission of the online application form. 5. In such view of the matter, this Court finds that respondents have not committed any illegality/ perversity in not considering the candidature of petitioner under the General EWS category. 6. As a result, the writ petition is hereby dismissed. 7. Stay application and pending application(s), if any, stand
disposed of.
