The applicant has filed the application under Section 528 of BNSS for quashing the impugned order dated 06.07.2022 passed by III Additional Chief Judicial Magistrate, Dehradun and order dated 04.02.2025 passed by IV Additional Chief Judicial Magistrate, Dehradun in Complaint Case No. 1637 of 2015, under Section 138 of Negotiable Instruments Act, 1881. 3. On the last occasion, applicant was permitted to take dasti notice on the respondent. After service of dasti notice, Mr. Akshay Latwal, learned counsel has put in appearance on behalf of the respondent. 4. Learned counsel for the applicant submits that the next date fixed in the court below is 27.02.2025 and he has undertaken before this Court that on that date, applicant would be permitted to cross-examine the complainant and he would seek no adjournment on that date. 5. Purely in the interest of justice, the request of the applicant is allowed. Applicant is allowed to cross-examine the complainant on 27.02.2025 and no further adjournment would be granted to the applicant for cross- examining the complainant. 6. A sum of Rs. 20,000/- be paid by the applicant to the complainant before cross- examination of the complainant under Section 311 Cr.P.C. 7. With the above directions and observations, the present application filed under Section 528 stands disposed of. 8.
