ORDER: The Criminal Petition is filed on behalf of the petitioner/accused to grant anticipatory bail in connection with Crime No.323/2018 of Tadipatri Town Police Station, Ananthapuramu District. 2) A case has been registered againstthe petitionerand others forthe offences punishable under Sections 147,143,148, 341, 324, 307, 353, 436 r/w 149 IPC. 3) Case of the prosecution in brief is that on 30.12.20218 at about 4.30 pm, at Vijayanagar colony, Tadipatri Town, accused K.V.Rasheed, his brother and his followers hatched a plan to kill the defacto complainant i.e. Sigi Pradeep Kumar working as PC 2526 of Cheennur police station of Kadapa District and Inspector Hammed Khan and other police staff, approached the accused on matka raid purpose and beat them. Subsequently the Inspector and PC and the defacto complainant were shifted to Government Hospital, Tadipatri for treatment. 4) Heard. Perused the record. 5) Learned Assistant Public Prosecutor submits that the petitioner was arrayed as A26 in the above said crime. But his name has not been shown as an accused in the First Information Report. -ssses3S3Z`
I 6) on a perusal of the material available on record goes to show that name of the petitioner has not been shown as an accused I'n the First Information Report. Specific overt acts Were attributed against the co- accused and a bald allegation has been made against this petitioner that the petitioner was an assocI'ate With the other accused. Except the said bald allegation that he was assocI|ated with the other accused, there is nothing on record to connect the petitl'oner with the crime. In vI'eW Of the } same, this Court is inclined to consider the prayer of antl'cipatory bail to the petitioner. 7) Accordingly, in the event of arrest of petitI'Oner/accused with regard to thl's crime, he sha" be released on bail on hl's executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) wl®th two sureties for the like sum to the satisfaction of the arresting police officials and also on condition that the petitioner shall make himself available for investigation as and when required and that he sha" not cause any threat, inducement or promise to the prosecution witnesses. petitioner shall appear before the station House Officer concerned once in a week i.e. on every sunday between 10.00 am and 05.00 pm, ti" filing of the charge-sheet. 8) Accordingly, the criminal petition I'S allowed.
