Petitioner has been made an accused in connection with S.T. Case No-622/2023, arising out of Satbarwa P.S Case No. 75/2023, Corresponding to G.R. Case No-1883/2023, registered under sections 302, 201/34 of the Indian Penal Code, pending in the court of Sri Raj Kumar Mishra, learned Additional Sessions Judge- VI-cum-Special Judge (ACB), Palamau at Daltonganj.
The petitioner happens to be the husband of the deceased Funka Devi. There was matrimonial dispute between the petitioner and the deceased due to which a panchayati was held and it was decided that the deceased will reside in her matrimonial home.
On 08.07.2023, deceased went missing, when the informant inquired her whereabout from the petitioner, he did not give any satisfactory reply. Later on, on the pointing out of the petitioner, the dead body of the deceased was recovered.
Postmortem report earlier called for has been received. It appears that the deceased was tortured before she was throttled to death.
Learned lawyer for the petitioner submitted that petitioner is in custody for about one and half year. It was further submitted that the viscera report has not been received as yet.
Regard being had to the facts and circumstance of the case and considering the nature of allegation; I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected.
