According to petitioners, they have moved an application under Section 28 of Consolidation of Holdings Act, 1953 to Deputy Director Consolidation on 16.11.2024 for delivery of possession of land, allotted to them in consolidation proceedings. 3. Petitioners have sought a direction to competent authority to deliver physical possession of the land by use of police force. 4. Learned State Counsel, however, submits that petitioners can move application before Assistant Consolidation Officer under Section 28/29 of the Act, while the application made by petitioners is to the Deputy Director Consolidation, who is not competent to pass order under Section 28/29 of the Act. 5. Learned counsel for the petitioners submits that petitioners will make fresh application to the competent authority under Section 28/29 of the Act. 6. Accordingly, the Writ Petition is disposed 2025:UHC:1273 of with liberty to petitioners, to make fresh application to competent authority. If petitioners make application within two weeks from today, the competent authority shall consider the same and pass necessary order in light of Section 28/29 of aforesaid Act within 6 months from date of receipt of such application.
