2. Learned counsel for the petitioner submits that order of this Court has not been complied by the respondents. Respondents have filed reply along with their affidavit. This Court has passed the order in WPS No.4796 of 2017 on 25.01.2024 and finds that the impugned order dated 17.04.2017 passed by the respondents (Annexure P-1) is set aside and respondents are
directed to grant the petitioner pay scale of Rs. 8000-13500 (as per 5th pay recommendation) and Rs.15600-39100+5400 (as per 6th pay recommendation) along with all other consequential benefits as per the actual entitlement of the petitioner and this Court also directed to respondents to let this exercise be concluded by the respondents within a period of 2 months from the date of receipt of copy of this order but respondents have assailed the order of co-ordinate bench of this Court by filing of the writ appeal thereafter respondents has filed SLP before the Hon’ble Supreme Court and dismissed the application for the respondents on 07.02.2025.
3. Learned counsel for the respondents contended that process remains contingent upon the requisite sanctions and approvals from the higher State authorities. The respondents are actively engaged in securing these necessary approvals and remains committed to fulfilling the court’s mandate at the earliest opportunity. He further submits that the respondent undertakes to ensure full and expeditious compliance as soon as the requisite approvals are granted by the competent authorities,
3 reaffirming and an unwavering adherence to the principles of justice and procedural propriety.
4. I have heard learned counsel for the parties at length.
5. On query being made by the Court learned counsel for the respondent submit that necessary approvals and powers with School Education Department therefore, learned counsel for the respondent is directed to inform the Secretary, Education Department, Chhattisgarh to order of this Court and same shall comply within 30 days from today failing which this Court may take serious view against the respondent authority.
6. With aforesaid observations/directions instant petition is
disposed of with liberty to file fresh application. Sd/-
