2. This is an application under Section 483 of the BNSS, 2023 praying for
Page No.# 2/2 granting bail to the accused/petitioner, namely Deepjyoti Das in connection with Chandmari Police Station Case No. 233/2025 under Section 118(2)/296/351(3) of BNS, 2023.
3. The facts of the case briefly stated is that the petitioner and the accused are residents of a PG Hostel and both are students. On the night of the demise of Zubeen Garg, an altercation took place between them when they were in an inebriated condition. As a result, the accused inflicted injuries upon the informant victim, which included biting off a part of the earlobe of the informant. Pursuant to lodging of the FIR, the accused was arrested on 21.09.2025 and by now, he has spent 51 days in custody.
4. Having regard to the nature of the allegations and progress of the investigation, further detention of the petitioner is not considered necessary and and thus, the prayer for bail is hereby allowed.
5. The accused abovenamed shall be released on bail of Rs. 20,000/- with one surety of like amount to the satisfaction of the learned Elaka Magistrate in connection with the aforesaid case. It is further provided that the petitioner shall cooperate with the investigation and shall not try to intimidate or influence witnesses.
6. The Bail Application stands allowed and disposed of accordingly.
