JUSTICE PRAVEER BHATNAGAR Order 08/09/2025
1. These instant bail applications have been filed under Section 483 of BNSS on behalf of accused-petitioners. The petitioners
[2025:RJ-JP:35905] (2 of 3) [CRLMB-9784/2025] have been arrested in connection with FIR No.184/2025 registered at Police Station Sarwar, District Ajmer for the offence(s) under Sections 115(2), 126(2), 189(2) and 3(5) of BNS. 2. Learned counsels for the accused-petitioners submit that the accused-petitioners have falsely been implicated in this case. They further submitted that the accused-petitioners are in custody since 18.07.2025 and trial of the case may take considerable time. It is further argued that the main allegation of assaulting and causing injuries to Shishupal, Sawar Lal and Govind are against other co- accused and the petitioners have not assaulted the injured, therefore, considering the above facts, these bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor and learned counsel for the complainant vehemently opposed the bail applications and contended that petitioners alongwith these other co-accused brutally assaulted injured Shishupal, Sawar Lal and Govind, as a result of assault they received grievous injuries. The incident was captured in the CCTV, therefore considering the nature of injuries caused to the injured, petitioners' bail applications deserved to be dismissed. 4. Heard and perused the material available on record. 5. In the CCTV footage presence of the petitioners' have not been shown but the presence of other co-accused Kanha, Mahipal Singh and Mukesh Gurjar have been found and their act was also recorded.
In the analysis report of the CCTV footage captured from the place of incident, it is mentioned that Kanha, Mukesh Gurjar and Mahipal assaulted the injured Sawar Lal, Govind and
[2025:RJ-JP:35905] (3 of 3) [CRLMB-9784/2025] Shishupal. It is not desirable to express anything on the merits of the case, considering the fact that the accused-petitioners are in custody since long and trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail application under Section 483 of BNSS are allowed and it is ordered that the accused-petitioners namely: 1.Rakesh S/o Ghisa, 2. Hanuman Prasad S/o Chotulal, 3. Sajjan Singh S/o Amar Singh, 4. Jaysingh @ Jaypal @ Bittu S/o Ramesh Singh, in connection with FIR No. 184/2025 registered at Police Station Sarwar, District Ajmer shall be enlarged on bail provided they furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
