THIS PETITION, COMING ON FOR ORDERS, THIS DAY, JUDGMENT WAS DELIVERED THEREIN AS UNDER: CORAM: HON'BLE MR V KAMESWAR RAO, ACTING CHIEF JUSTICE and HON'BLE MR JUSTICE C M JOSHI ORAL JUDGMENT (PER: HON'BLE MR V KAMESWAR RAO, ACTING CHIEF JUSTICE) This contempt petition has been filed with the following prayer, "Wherefore, it is prayed that, this Hon'ble Court be pleased to punish the Accused/ Respondent for having deliberately and intentionally disobeyed the order dated 27.03.2025 on I.A.No.3 passed by the learned Principal Judge, Family Court, Bengaluru, produced at Annexure-E and also that of the order dated 25.04.2025 on I.A.No.4 and 5 in M.C.No.639/2025 passed by the learned Principal Judge, Family Court, Bengaluru, produced at Annexure-L, in the interest of justice and equity." - 3 - HC-KAR NC: 2025:KHC:18762-DB CCC No. 565 of 2025 2. On the last date of hearing, this Court had directed the presence of the child before this Court. Today, the child has been produced. 3. We have heard the learned counsel for the parties. 4. Insofar as the allegation of violating the order of 27.03.2025 is concerned, the same is primarily on the ground that the child has been taken outside the jurisdiction of the Trial Court. 5. Today, the learned counsel for the respondent has filed a counter stating that the child was sent to her grandparents in Mumbai on 22.03.2025 i.e before the order of 27.03.2025 was passed and, in that sense, there is no contempt of the order of 27.03.2025. In fact, during the course of hearing, the learned counsel for the complainant concedes to the fact that such a plea was urged by the learned counsel for the respondent before the Court concerned when the order dated 27.03.2025 was passed. 6. The other submission of the learned counsel for the complainant is that the latter part of the order dated - 4 - HC-KAR NC: 2025:KHC:18762-DB CCC No. 565 of 2025 25.04.2025 (Pages 20 and 21) that the complainant is not being allowed the visitation rights granted by the court below on the first and third Sunday between 11.00 a.m to 6.00 p.m with permission to the complainant to take the child with him from the house of the respondent at 11.00 a.m and handover the child to the house of the respondent the same day at 6.00 p.m either in Bengaluru or Mumbai where the child is residing is not being complied with. Concedingly the child is residing in Mumbai. The learned counsel for the respondent, on instructions, states the said directions of the Family Court, Bengaluru shall be implemented in letter and spirit. The submission is taken on record. 7. As we note that the visitation rights were also allowed to the complainant during the summer vacation, we are informed that summer vacation shall come to an end on 11.06.2025, i.e. 12.06.2025 being the re-opening day, it is agreed by the learned counsel for the respondent, on instructions from the respondent, that the petitioner shall be at liberty to have visitation rights as per order dated 25.04.2025 till 11.06.2025 as ordered by the Family Court in paragraph 29 - 5 - HC-KAR NC: 2025:KHC:18762-DB CCC No. 565 of 2025 (Pages 19 and 20) which confines the visitation rights of the complainant during the summer vacation. 8.
