Lal, the learned counsel for the petitioner. Also heard Mr. F.K. R. Ahmed, the learned counsel for the respondent, who submits that the respondent has already filed Page No.# 2/3 a written objection against the prayer made by the learned counsel for the petitioner and therefore, this matter may be taken up for admission hearing. 2. This application under Section 24 of the Code of Civil Procedure, 1908 has been filed by the petitioner, namely, Smti. Anuradha Gope praying for transfer of F.C.(Civil) Case No. 1079/2024, which was filed by the respondent seeking divorce from the petitioner in the court of the learned Principal Judge Family Court No. II, Kamrup (M) at Guwahati to the court of the learned District Judge, Sonitpur. 3. The learned counsel for the petitioner submits that the petitioner is presently residing at Sonitpur and she had already filed a case seeking monthly maintenance from the respondent, and which was registered as MR Case No. 34/2020 which is pending in the court of the learned Judicial Magistrate First Class, Sonitpur at Tezpur and therefore, he submits that it would be convenient for both the parties, if both the cases between the parties are taken up a common district, i.e. at Tezpur. 4. The learned counsel for the respondent submits that though the respondent has filed a written objection in this case, however, he has been instructed that the respondent does not have any objection if the prayer of the present petitioner for transferring F.C. (Civil) No. 1079/2024 to the court of the learned District Judge, Sonitpur is allowed. Page No.# 3/3 5. Considering the submissions made by the learned counsel for both sides as well as considering the grounds stated by the petitioner in her transfer application, this transfer petition is allowed. 6. The F.C. (Civil) No. 1079/2024 is transferred to the court of the learned District Judge, Sonitpur. 7. The learned Principal Judge Family Court No. II, Kamrup (M) shall send the records of the aforesaid case to the court of the learned District Judge, Sonitpur. The learned District Judge, Sonitpur shall proceed with the aforesaid case from the stage at which it is pending now. 8. Since both the parties are represented before this court by their engaged counsel, hence they are directed to appear before the court of the learned District Judge, Sonitpur on 10th February, 2026. 9. The learned Principal Judge Family Court No. II, Kamrup (M) shall ensure that records of the aforesaid cases reaches the court of the learned District Judge, Sonitpur before the aforesaid date. 10.
