failed to register FIR despite the receipt of the said complaint nor taken any action against the accused mentioned in the complaint as illegal, arbitrary and violative of Article 14,19 and 21 of Constitution of India and also in contravention of Apex Court Judgment in Lalita Kumari V. Government of U.P., and consequently direct the Respondent Police to register the complaint of the petitioner and take appropriate action in the matter in accordance with law and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondent Police to register the complaint dt. 02.06.2025 forthwith pending disposal of the above writ petition and to pass Counsel for the Petitioner:

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue writ order or direction more particularly one in the nature of Writ of Mandamus under Article 226 of the constitution of India by declaring the action of Respondents Nos.3 and 4 in not disposing the complaint of the petitioner dt.02.06.2025 in accordance with law, without doing any investigation or giving any opportunity to submit evidence and failed to register FIR despite the receipt of the said complaint nor taken any action against the accused mentioned in the complaint as illegal, arbitrary and violative of Article 14 19 and 21 of Constitution of India and also in contravention of Apex Court
Judgment in Lalita Kumari V. Government of U.P., and consequently direct the Respondent Police to register the complaint of the petitioner and take appropriate action in the matter in accordance with law and to pass such other order or orders…”
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home representing the respondents.
3. Learned Assistant Government Pleader for Home, on instructions, would submit that the Police have not registered the crime on the representation of the petitioner, since the matter is of civil in nature.
4. Recording the same, the Writ Petition is disposed of. However, the petitioner is at liberty to recourse his remedies before the appropriate forum according to law. No order as to costs.
