OMP(M) No. 430 of 2025 The present application has been filed by the applicant/appellant seeking condonation of delay of 150 days in filing the present appeal. As per the averments made in the application, it is stated that a certified copy of the judgment dated 02.12.2024 was applied for by the counsel on 14.01.2025, the same was prepared on 10.02.2025 and delivered on 24.02.2025. Thereafter, the record was prepared in the month of March, 2025. It is submitted that the delay in filing the appeal occurred due to unavoidable circumstances. Learned counsel for the respondent/non- applicant has stated that they have no objection if the present application is allowed. In view of the averments as made in the application, which is duly supported by an affidavit and keeping in view the fact that the learned counsel for the non-applicant has no objection in case delay is condoned, the present application is allowed and the delay of 150 days in filing the appeal is condoned.
