This Criminal Petition, under Sections 480 & 483 of the BNSS, has been filed by the petitioner/Accused, seeking regular bail, in Crime No.247 of 2024 of Mannur U/G Police Station, Anantapuram District registered for the offence punishable under Section 108 of the BNSS. 2. Case of the prosecution is that accused and the deceased were in love with each other and the accused promised to marry her. But instead of marrying her, he married another one and he disrupted the marriage of deceased arranged by her mother and instigated her to commit suicide. On the date of the incident, mother of deceased left the house to attend tonsure ceremony of her niece at Penchalakona keeping alone and the deceased was at home. Later she returned to home and found that the deceased was hanging to an iron pipe of asbestos sheet roofed house with her chunni. 2
3. Heard. Perused the record. 4. On perusal of the material on record goes to show that the petitioner herein and the deceased were in love with each other. Thereafter, the petitioner married other woman and the deceased has gone into depression. The mother of the deceased, who was staying in Kuwait, came to the deceased and got engaged her to other person. At that juncture, the petitioner herein disrupted the marriage proposal of the deceased with another person and also refused to marry her. Because of the same, the deceased, having vexed with her life, committed suicide by hanging on 11.11.2024 at her house. The petitioner was arrested on 13.11.2024. Learned Assistant Public Prosecutor submits that at the instance of the petitioner, the deceased has taken the extreme step of committing suicide. He further submitted that some more witnesses are to be examined in the present case. 5. Since the investigation is pending, at this stage, this Court is not inclined to grant bail to the petitioner. 6. Accordingly, the Criminal Petition is dismissed.
