City Civil & Sessions Judge, Bengaluru arising out of Crime No.78/2024 registered by Seshadripuram Police Station, Bengaluru City for the offences punishable under Sections 103(1), 61(2), 126(2) and 190 of BNS, 2023 and Section 4, 25-1(B)(b) of the Arms Act is before this Court under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel appearing for the parties. 3. FIR in Crime No.78/2024 registered by Seshadripuram Police Station, Bengaluru City initially for the offences punishable under Sections 103(1), 3(5) & 61(2) of BNS, 2023 against one Naga and others, on the basis of first information dated 01.08.2024 submitted by Smt. Charulatha wife of deceased Ajith Kumar. During the course of investigation, the petitioner herein was arrested on 18.08.2024 and subsequently remanded to judicial - 3 - HC-KAR NC: 2025:KHC:18945 CRL.P No. 6887 of 2025 custody. Investigation of the case is completed and charge sheet has been filed and in the said charge sheet, the petitioner is arraigned as accused No.7. 4. The bail application filed by the petitioner before the jurisdiction Sessions Court in Crl.Misc.No.11794/2024 was dismissed on 23.01.2025. Therefore, he is before this Court. 5. Learned counsel the petitioner submits that allegation of assaulting deceased Ajith Kumar with weapons is only against accused Nos.1 and 2. The allegation against the other accused is that they had conspired to commit the murder of Ajith. All the other accused persons as against whom similar allegations are made have been enlarged on bail. The petitioner has no other criminal antecedents. Accordingly, he prays to allow the petition. 6. Per contra, learned HCGP who has opposed the petition however does not dispute the submission made by learned counsel for the petitioner. - 4 - HC-KAR NC: 2025:KHC:18945 CRL.P No. 6887 of 2025 7. Perusal of the material on record would go to show that, accused Nos.3, 4, 12 & 13, who are the close relatives of Ganesh had allegedly conspired with other accused persons to commit the murder of Ajith Kumar, who was one of the accused in the murder case of Ganesha @ Ganeshraj, in respect of which FIR in Crime No.128/2022 was registered by Seshadripuram Police Station, Bengaluru. In furtherance of such conspiracy, accused Nos.1 and 2 allegedly committed the murder of Ajith Kumar on 01.08.2024 by assaulting him with deadly weapons. 8. The allegation as against the petitioner is that he had conspired with the other accused persons to commit the murder of Ajith Kumar. Undisputedly, he has no other criminal antecedents. The other accused persons as against whom there is an allegation of conspiracy to commit the murder of Ajith Kumar have been granted regular bail by this Court in Crl.P.No.14041/2024, Crl.P.No.106/2025 C/w Crl.P.No.266/2025. Under these - 5 - HC-KAR NC: 2025:KHC:18945 CRL.P No. 6887 of 2025 circumstances, I am of the opinion that, the prayer made by the petitioner for grant of regular bail needs to be answered in the affirmative. 9. Accordingly, the following: ORDER Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.216/2025 pending before the Court of LII Addl. City Civil & Sessions Judge, Bengaluru arising out of Crime No.78/2024 registered by Seshadripuram Police Station, Bengaluru City for the offences punishable under Sections 103(1), 61(2), 126(2) and 190 of BNS, 2023 and Section 4, 25-1(B)(b) of the Arms Act, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 6 - HC-KAR NC: 2025:KHC:18945 CRL.P No. 6887 of 2025 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS
