1. Heard Mr. C.K. Nath, learned counsel for the petitioner and also heard Mr. R.J. Baruah, learned Addl. P.P for the State. 2. This application has been filed under Section 483 BNSS, seeking bail of the petitioner, namely, Khalil Ali, who was arrested on 26.09.2025 in connection with All Women P.S. Case No. 79/2025 under Sections

That the brief of the case is that on 25.09.2025 complainant Dipali Hazarika, lodged an FIR before the Officer-in-Charge of All women Police Station to the effect that she is a widow with her only daughter residing in a rented house near Idol Nursery in Fatasil Ambari. Through personal acquaintance a married man namely Khalil Ali has been physically and mentally harassing her. This man has hacked her personal mobile number and mentally harassed her also hurt her personal character by sending messages, audio call recordings etc in her whatsapp through an employee namely Dolly in her office. Further at her residence, office and while on the way he threatened her and forcibly took away Rs. 50,000/- which she had saved for her daughter's education. Khalil has also been diminishing her self esteem by posting photos on his own Facebook account without her knowledge. Yesterday she went to the Panbazar Women Police Station and informed about the incident. Police made a telephonic called and asked him to appear at the Police Station. Last night Khalil Ali went to the complainants house, threatened and verbally abused her. On 25.09.2025 at around 10:30 AM Khalil again went to her house and verbally abused her in a provocative language outside her house. At that time when her daughter went to nearby shop he obstruct her way and verbally abused and tried to attack her, her daughter managed to escape and told the complainant about the incident.
When Khalil could not do anything to them, he cut the rear wheel of her scooty parked at her compound with Daa. Hence the case. The FIR was received and registered as All Women Police Station Case No: 79/2025

It is submitted on behalf of the petitioner that the informant was a widower whom the petitioner married under the Muslim law before the kaji and then a marriage certificate issued by the All Assam Imam council has also been annexed to the instant application. 5. The petitioner was arrested on 25.09.2025 and forwarded on 26.09.2025 and thereby he has spent around 47 days in custody. 6. Having regard to the nature of the allegations further detention of the custody may not be necessary. 7. Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs.50,000/- (Rupees Fifty Thousand) with one surety of like amount to the satisfaction of learned CJM, Kamrup(M) in connection with the aforesaid case subject to the following conditions:- (a) That the accused person shall co-operate with the investigation (b) That the accused person shall not try to intimidate the witnesses. 8. Accordingly, the bail petition is disposed of. JUDGE Comparing Assistant
