1. Heard Mr. M. I. Hussain, the learned counsel for the petitioner. Also heard Mr. P. Borthakur, the learned Additional Public Prosecutor for the State respondent.
2. This application under Section 482 of BNSS, 2023 has been filed by the petitioner, namely, Dilip Kalita, seeking pre-arrest bail in connection with Gorchuk P.S Case No. 214/2025 registered under Section 306/316(4)/318(4) of
Page No.# 2/2 BNS, 2023; corresponding to GDE No.30 dated 02.07.2025.
3. The petitioner Dilip Kalita, is stated to be the father of David Kalita, the sole FIR named accused, who has already been granted anticipatory bail by this Court vide order dated 27.10.2025.
4. The petitioner was granted interim pre-arrest bail on 18.11.2025 pursuant to which complying with bail condition, he stated to appear before the Investigating Officer and the same is confirmed by the learned Additional Public Prosecutor, who also has the case diary available with him.
5. The main allegations are against the son of the present petitioner, who has been enlarged on bail already vide order dated 27.10.2025 passed by this Court in AB No. 2020/2025.
6. With regard to the present petitioner, I see no reason to cancel his interim anticipatory bail. Accordingly, the interim bail is hereby made absolute subject to the conditions that: i. The petitioner shall render cooperation with the remaining investigation; ii. The petitioner Shall not hamper or tamper with the evidence.
7. Return the case diary.
