1. Heard Mr. M. R. Khandakar, learned counsel for the petitioners. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam.
2. This application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in respect of PRC Case No.1610/2023, pending in the Court of the learned Sub-Divisional Judicial Magistrate (M), Hatsingimari.
3. Learned Additional Public Prosecutor has objected to this bail application on the ground that the allegation brought against the petitioners is that they have kidnapped a minor girl and later on they sold that girl.

Learned counsel for the petitioners submits that both the petitioners are shown as absconders in the Charge-Sheet and now they want to contest this case. According to the learned counsel for the petitioners, since the allegation comes within the purview of the Court of Sessions, they shall be remanded to custody, when they appear before the learned Sub-Divisional Judicial Magistrate (M), Hatsingimari.
5. I have considered the submissions made by the learned counsel for both sides.
6. Call for the Case Diary.
7. This Court is of the opinion that since both the petitioners are interested in facing the Trial, they deserve to be given adequate opportunity to that effect.
8. Therefore, the anticipatory bail application of the petitioners is allowed.
9. It is hereby directed that both the petitioners Sokibar Rahman @ Sokibar Rahman Mondal and Mominur Rahman @ Maminur Islam shall appear before the learned Sub-Divisional Judicial Magistrate (M), Hatsingimari within next 7 (seven) days from today and on their appearance, both the petitioners shall be released on bail of
Page No.# 3/3 Rs.25,000/- each with a surety of like amount to the satisfaction of the learned Sub- Divisional Judicial Magistrate (M), Hatsingimari.
10. With the aforesaid direction, this anticipatory bail application stands disposed of.
