The present Writ Petition is filed questioning the action of the Respondents in not releasing the first and final bill amount, which is admittedly due to the Petitioner despite successful completion of work under Agreement No.312 of 2023-24, dated 14.03.2024 for the work i.e. Restoration of CC Road from D.No.91/4-23-16 to D.No.9/3-141 of Balaji Nagar in Ward No.40 within the limits of Kurnool Municipal Corporation entered with the Respondent No.3 even after successful completion of work and in spite of repeated requests, as illegal and arbitrary. 2. Heard M/s. V. Nitesh, learned counsel for the Petitioner and Sri P. Vengala Reddy, learned Standing Counsel appearing for the Respondent-Corporation. 3. The learned counsel for the Petitioner submits that the work was successfully executed and entries in M. Book were also recorded by the writ petitioner. However, in spite of the work being concluded, the amount of Rs.8,56,770/- is not paid. Hence, the present Writ Petition is filed. 4. The Respondent No.3 filed Counter Affidavit, wherein it is stated that the writ petitioner had commenced the above work under the Agreement and completed the same within the time prescribed and detailed measurements of the work were recorded in M. Book vide M. Book No.653-2023-24 and the bill was passed for an amount Rs.9,70,240/- for the said work and after scrutiny of the bill duly making statutory deductions, the net amount payable to the writ petitioner was Rs.8,56,770/-. It is further stated that as no amount available the Petitioner would not be paid. 3 5. Since the execution of work and the amount due to the Petitioner are not in dispute and considering that the Petitioner had executed the work long back, this Court is of the opinion that the Writ Petition can be disposed of with the following direction: (i) The Respondent authorities are directed to pay the amount due to the Petitioner within a period of four (4) months from today. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
