Gupta, learned counsel for the applicant prays for condoning the delay of 26 days in filing the appeal against his conviction under Section 376(3) Page No.# 2/2 of IPC read with Section 4(2) of the POCSO Act, 2012. The applicant was thereafter sentenced under Section 376(3) of IPC. Ms. B. Bhuyan, leaned Senior Counsel and Additional Public Prosecutor, Assam submits that she has got no objection to the delay being condoned. On considering the submissions made by the learned counsels for the parties, the delay of 26 days is condoned. Registry to list the appeal. I.A.(Crl.) stands disposed of.
