Captioned main ‘writ appeal’ (‘WA’ for the sake of brevity) is an intra-court appeal and the same has been filed assailing a common interim order dated 14.11.2025 made by a Hon’ble Single Bench in MC(WP(C)) Nos. 822 of 2025 and 823 of 2025 in W.P.(C) No. 227 of 2024 (hereinafter ‘impugned order’ for the sake of brevity, convenience and clarity). [2]
Mr. Kh. Tarunkumar, learned senior advocate instructed by Mr. W. Jamon, learned counsel on record for appellant is before this Court.
[3] Short facts (shorn of elaboration and particulars which are not imperative for appreciating instant order) are that, the Cycling Federation of India (this Court is informed that this Federation is State within the meaning SHAMURAILATPAM SUSHIL SHARMA Digitally signed by SHAMURAILATPAM SUSHIL SHARMA Date: 2025.11.20 20:25:51 +05'30' Page 2 of 10 of Article 12 of the Constitution of India) which is R1 before this Court made an order dated 08.03.2024 disaffiliating writ appellant; that it is necessary to write that ‘R1’ denotes ‘first respondent’ and similar abbreviations will be used with regard to other respondents also; that the appellant is Manipur Cycling Association and this Court is informed that the appellant is registered as a Society which was originally registered as Society under the Central 1860 Act {the Societies Registration Act, 1860 (21 of 1860)} and subsequently, by virtue of deeming provision under Section 34(2) of the Manipur Societies Registration Act, 1989; (‘State Registration Act’ for convenience) and ‘Central 1860 Act’ shall be referred to as ‘1860 Central Act’; that ‘the appellant Association’ shall be referred to as ‘MCA’ denoting ‘Manipur Cycling Association’ and ‘R1’ shall be referred to as ‘CFI’ denoting ‘Cycling Federation of India’; that, MCA is affiliated to CFI; that ‘CFI’ in and vide order dated 18.03.2025, disaffiliated MCA (as mentioned earlier); that MCA challenged the disaffiliation order dated 08.03.2024 by way of WP(C) No. 227 of 2024; that the Hon’ble Single Bench granted an interim order on 22.03.2024 suspending the disaffiliation and this interim order is operating until today; that, it is to be noted that the interim order was granted by one of us (Justice Ahanthem Bimol Singh); that the main ‘writ petition’ (‘WP’ for the sake of brevity) is pending; that pending WP, CFI took out an application in MC(WP(C)) No. 823 of 2025 with a prayer to vacate the interim order dated 22.03.2024; that MCA took out another MC(WP(C)) No. 822 of 2025 with a prayer that a team selected by MCA on 05.11.2025 alone should be permitted to participate in the 30th National (Senior, Junior & Sub Junior) Road Cycling Championship at Shambalpur, Odissa to be held from Page 3 of 10 02.12.2025 to 06.12.2025; that the 2 (two) MCs were taken up by Hon’ble Single Bench and the impugned order (constituting a Special Committee to select cyclists) came to be made; that assailing the impugned order, MCA has filed the
captioned intra-court appeal; that in and vide impugned order, Hon’ble Single Bench has constituted a Committee headed by the President of the Manipur Olympic Association, representatives of the Directorate of Youth Affairs and Sports, representative of MCA, representative of CFI and
directed them to make selection; that the last date for submission of list of players was also extended till 21.11.2025 by the impugned order; that it is the case of MCA that MCA alone is competent to select cyclists to participate in the national championship and therefore, the interim order (impugned
order) constituting a Committee in the manner set out herein is incorrect and deserves to be interfered with; that the captioned writ appeal along with the captioned MC thereat is before this Court. [4]
Mr. Kh. Tarunkumar, learned senior advocate, on instructions, submitted that MCA has selected as many as 21 (twenty one) cyclists on
05.11.2025. It is also submitted that MCA did not participate in the selection conducted by the Special Committee put in place by the Hon’ble Single Bench vide the impugned order. It was submitted that MCA did not participate as it intended to challenge the interim order. As regards the provision which enables MCA to be the lone authority for selecting candidates for participating in the national championship, it was submitted that it is on the basis of affiliation and other arrangements between MCA and CFI but all these questions are left open for the present owing to what unfurled in the
hearing about which there will be allusion elsewhere infra and the order we propose to make. [5]
As MCA has selected a team of 21 cyclists and a Special Committee has been constituted to select cyclists, in larger public interest and in the interest of the best talent representing the State of Manipur and ultimately the country, we issue notice to the respondents. [6]
Mr. P. Tamphamani, learned counsel who is present in the physical court accepts notice for R1 and R2 (CFI) and Mr. Ramnik Mishra,
learned counsel, appears on V.C. platform (Video Conferencing) on his behalf. Ms. Ch. Sundari, learned State counsel accepts notice for R3 and R4.

Learned counsel for R1 and R2 viz., CFI submitted that the Special Committee constituted by the Hon’ble Single Bench vide the impugned order has made selection and it selected 22 (twenty two) cyclists. The list of 22 (twenty two) cyclists selected by Special Committee has been placed before this Court. The list is as follows :

As regards the 21 (twenty one) cyclists selected by MCA on 05.11.2025, the list placed before us as follows :

After some submissions on both sides, we find that out of the 43 (forty three) cyclists in all (21 selected by MCA and 22 selected by the Special Committee, 4 (four) are common). [10]
The last date for the entries as extended by the impugned
order is tomorrow i.e., 21.11.2025. We now extend the same and make it
24.11.2025. The national championship is to be held from 02.12.2025 to
06.12.2025. To be noted, this national championship is conducted by CFI. [11]
Before we proceed further, it is deemed appropriate to record that learned State counsel who accepted notice for R3 and R4 very fairly submitted that State is more in the nature of a formal party and it would stand bound by any order that is made by this court. To be noted, the State has been shown as proforma respondents even according to the appellant. [12]
In the light of the scenario that unfurled in the hearing, with the consent of all the afore-referred counsel i.e., Mr. Kh. Tarunkumar, learned senior advocate appearing on behalf of Mr. W. Jamon, learned counsel on record for the appellant MCA, Mr. P. Tamphamani, learned counsel in the physical court for R1 and R2 who is represented by Mr. Ramnik Mishra, learned counsel on VC platform on his behalf (to be noted R1 and R2 is CFI) and Ms. Ch. Sundari, learned State counsel for R3 and R4, the main writ appeal along with the MC was taken up and heard out without the respondents insisting on filing affidavits in opposition in the MCs or seeking him for getting instructions. This Court inter-alia taking into account larger public interest and to ensure that best of talent on behalf of the State of
Manipur participates in the national championship and ultimately gets to represent the country heard out the matter. [13]
After some arguments of the learned counsel before us, viz., Mr. Kh. Tarunkumar, learned senior advocate appearing on behalf of Mr. W. Jamon, learned counsel on record for the appellant MCA, Mr. P. Tamphamani, learned counsel in the physical court for R1 and R2 who is represented by Mr. Ramnik Mishra, learned counsel on VC platform on behalf (to be noted R1 and R2 is CFI) and Ms. Ch. Sundari, learned State counsel for R3 and R4, agreed to have the captioned intra-court appeal i.e., WA and MC thereat disposed by a common consent order. [14]
Before we write the consent order, it is necessary to record some other facts which are relevant for appreciating this order and for implementing/operationalizing instant order.
This is, we (this Court) are informed that as regards the cyclists who are to participate in the national championship, there are 4 (four) categories and they are follows :
i) Elite and Men under 23;
ii) Juniors;
iii) Sub-Juniors;
iv) Youth. [15]
We also deem it appropriate to set out the above categories in the form of a tabulation as regards the number of cyclists and sub breakups qua gender/age thereat. The tabulation is as follows :

The consensus arrived at is, all the 39 (thirty-nine) candidates i.e., 21 (twenty one) selected by MCA and 22 (twenty two) selected by the Special Committee (to be noted, 4 (four) are common as alluded to supra) will now participate in the 30th National (Senior, Junior & Sub Junior) Road Cycling Championship at Shambalpur, Odissa to be held from 02.12.2025 to
06.12.2025. The national championship is conducted by CFI (R1 and R2) as already alluded to supra. Learned counsel for R1 and R2, on instructions, very fairly consented to have the afore-referred cap in the categories relaxed to enable all the 39 (thirty nine) candidates to participate in the national championship. This submission is recorded.

The following order is made :
i) All the 39 (thirty-nine) cyclists figuring in the 2 (two) tables supra (paragraphs 7 and 8 supra), 21 (twenty one) selected by appellant MCA (Manipur Cycling Association) and 22 (twenty two) selected by the Special Committee (4 (four) being common) will participate in the 30th National (Senior, Junior & Sub Junior) Road Cycling Championship at Shambalpur, Odissa to be held from 02.12.2025 to 06.12.2025; ii) R1 and R2 (CFI) has relaxed the cap in terms of number of cyclists in each category to enable all 39 (thirty nine) cyclists to participate; iii) The last date for entry is extended upto 24.11.2025; iv) The afore-referred consent made by all the parties before us is for the very limited purpose of the 30th National (Senior, Junior & Sub Junior) Road Cycling Championship and it should not be cited as a precedent; v) All questions are left open and the main WP will be heard out by the Hon’ble Single Bench on its own merits and in accordance with law untrammeled by instant
order; vi) List of 39 (thirty nine) candidates shall be sent/entries taken on file at the earliest/forthwith and in any event on
or before 24.11.2025 and R1 and R2 (CFI) shall ensure that all 39 (thirty nine) cyclists participate; vii) Hon’ble Single Bench is requested to take up the main WP on a date after 06.12.2025 and post 06.12.2025 date will be subject to the official business of the Hon’ble Single Bench. [18]
Before concluding, this Court places on record its appreciation for the fair stand taken by all the parties and all the counsel and senior counsel which serves the best interest of sports talent in the State of Manipur and ultimately in the country. [19]
The captioned main writ appeal (WA) is disposed of by way of instant consent order in the aforesaid manner. Consequently captioned MC thereat is disposed off as closed. [20]
There shall be no order as to costs.
