No. 236-3 and Ac. 0.46 cents in Sy. No. 242-3 respectively situated at Hemavathi Revenue Village, Amarapuram Mandal, Sri Satya Sai District as illegal, arbitrary, violation of principles of natural justice and violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the 4TH respondent not to interfere in the above said lands and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 4TH respondent not to dispossess the petitioners from the lands being an extent of Ac. 1.34 cents in Sy. No. 236-3 and Ac. 0.46 cents in Sy. No. 242-3 respectively situated at Hemavathi Revenue Village, Amarapuram Mandal, Sri Satya Sai District, pending disposal of the writ petition, and to pass Counsel for the Petitioner(S): 1. Narasimhulu, learned counsel for the petitioners and Sri B.V. Satyanaryana, learned Assistant Government Pleader for Revenue, appeared for respondents 1 to 4. Notice of respondents 5 to 7 is dispensed SRS,J W.P.No.19114 of 2025 with since no adverse orders are passed against the rights and interests of respondents 5 to 7. 2. Learned counsel for the petitioners would submit that the petitioners are owners of land of an extent of Ac.1.34 cents in Sy.No.236-3 and Ac.0.46 cents in Sy.No.242-3 of Hemavathi Revenue Village, Amarapuram Mandal, Sri Satya Sai District. Respondent No.4 issued Pattadar Pass Book and Title Deed in the name of the petitioner’s father. The petitioners made a representation under Form VI-A to mutate their names. Be that as it may, respondent No.4, on 16.07.2025, came to the subject land and tried to dispossess the petitioners, at the behest of respondents 5 to 7. 3. Sri B.V. Satyanaryana, learned Assistant Government Pleader for Revenue, on instructions, would submit that respondent No.4 is not interfering with the aforementioned property. The same is recorded. 4. Given the facts and circumstances of the case, without touching the merits of the matter, the Writ Petition is disposed of at the stage of admission with the consent of both the learned counsel, directing respondent No.4 not to interfere with the land of an extent of Ac.1.34 cents in Sy.No.236-3 and Ac.0.46 cents in Sy.No.242-3 of Hemavathi Revenue Village, Amarapuram Mandal, Sri Satya Sai District, without following due process of law. No order as to costs.
