EE Dr. .YLR, J CrI.P.No.7742 of 2025 Dated 07.08.2025 The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity {the BNSS') petitioners/accused for granting of pre-arrest bail in connection with crime No.280 of 2024 of Bommuru Police Station, East Godavari District, registered for the alleged offences punishable under Section, 7-B read with 8-A of the Andhra'~'Pradesh Prohibition Act, 1995, (for brevity [the APPA]). 2. The case of the prosecution is that on 30.07.2024 at 5:00 P.M. at ladies colony, Kavalagoyya Village, Rajamah`endravaram Rural, the de facfo complainant one B.Srinu, Sub-Inspector of Police, Bommuru Police Station, conducted raid along with his staff on illegal possessl-on and manufacturing of illI'Cit arraCk. The petitioners absconded during the raid, who were in illegal possession and manufacturing of 400 liters of I.D. arrack packed in 10 plastic tins and JF wash in 30 plastic containers about 200 liters each.
Later the de facfo complainant destroyed the JF wash of 6000 liters, which was buried in the ground and seized 400 liters of I.D, arrack worth Rs.12,000/-and also collected a sample of 350 ml from each plastic`-tin_.for sending the same for chemical analysis report
T- Dr. YLR, I Crl.P.No.7742 of 2025 Dated 07.08.2025 from the scene of offence under the cover of mediator's report. The incident was reported on 30.07.2025 at 6:30 P.M. by the de facfo complainant. A case was registered based on the said complaint given by the de facfo complainant. 3. Sri Singamsetty V.M. Sankar, the learned'counsel for the petitioners, contends that the petitioners are innocent of the alleged offences and there are political rivalries between the petitioners and the other accused, therefore, they were falsely I'mP`liCated by the in this case. tJ It is submitted that a memo is filed by the petitioners, appending the mediatorJs report, which shows that there are no adverse antecedents against the petitioners. [t is further submitted that the petitioners are ready to abide any conditions that may be imposed by this court, and it is urged to grant pre-arrest bail to the petitioners
4. Per cor7fra, Ms. P. Akila Naidu, the learned Assistant Publ,ic Prosecutor vehemently opposed the grant of pre-arrest bail to the petitioners, submitting that the investigation is still underway and several ma,ferial witnesses remain to be examined. lt is contended that if the petitioners are released on pre-arrest bail, there is a strong likelihood that they may abscond, thereby hampering the ongoing investigation zE=-=
5 Dr. YLR, J Crl.P.No.7742 of 2025 Dated 07.08.2025 and evading the process of law. In view of the foregoing, it is urged that the petition be dismissed. 5. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record.
6.I On perusal of the record, it appears that there are no adverse antecedents against the petitioners and there are some political disputes between the petitioners and the other accused. I/

Considering the gravity and nature of the allegations leveled against the petitioners, this Court deems it fit to grant pre-arrest bail to the petitioners. 8. ]n the result, the Criminal Petition js allowed with the following conditions: i. In the event of' their arrest, the petitioners/Accused be enlarged on bail subject to they executing, personal bond for a sum of Rs.10,000/-(Rupees Ten Thousand only), each with two sureties for the like sum each {o the satisfaction of the arresting police officials; ii. The petitioners/Accused shall make themselves available for investigation as and when required;

The petjtjoners/Accused shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The petitioners/Accused shall not leave the dI-Strict tJ limits without the express permission from the station House Officer concerned. vi. The petitioners/Accused shall surrender their Passports, if any, tO the investigating Officer.
