Page No.# 2/3 Dispur Police Station Case no. 563/2025 registered under Section 143(2) of BNS, 2023, corresponding to G.R. Case no. 3410/2025. 3. The FIR dated 07.06.2025 lodged by the brother of the victim reveals that the victim who had gone missing from a particular area, called up the informant saying that her co-worker namely, Sukur Ali, under the pretext of false marriage proposal, sold the victim to someone who hails from Haryana and that the victim informed her brother that she is passing her days in great distress and requested her brother to rescue her form Haryana. 4. It is noticed that the petitioner was arrested on 15.07.2025 and is behind the bars since then. It is also noticed that the petitioner was remanded on 08.07.2025 with 5 (five) days transit remand and it transpires that the petitioner has been inside the jail for 149 days. 5. It is provided under Section 187 of the BNSS, 2023 that if the investigation is not completed within a period of 90 days in case of offences punishable for a term of more than 10 years, the arrested accused person is entitled for default bail. 6. In the instant case, it is noticed that the charge-sheet has not been filed although 90 days period is over from the date of arrest of the accused person, the petitioner is entitled for default bail. Accordingly, the petitioner is released on default bail on furnishing a bail bond of Rs.
20,000/- with one local surety of the like amount to the satisfaction of the Chief Judicial Magistrate, Kamrup (M) under the following conditions :- (i) The petitioner shall appear before the Investigating Officer as and
Page No.# 3/3 when called for, (ii) The petitioner shall not leave the territorial jurisdiction of the learned CJM, Kamrup (M) without prior information to the Investigating officer of the case, (iii) The petitioner shall not hamper with the investigation or tamper with the evidence of the case, and (iv) The petitioner shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer. 7.
