Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS to declare action of the Respondent Police in interfering and meddling with civil disputes which was exists between Petitioner and parties in respect to mortgaged property which is subject matter property of suit in O.S.NO 81 of 2024 third on the file of the Principal Civil Judge (Senior Division) at Srikakulam and the police are every day calling pressurize the Petitioners the petitioners to police station and to compromise civil disputes with dire consequences despite pendency of suit before the competent civil court which sub- judice highly illegal, arbitrary unjust and unconstitutional and violative of Articles 300-A, 14, 21 of the Constitution of India and violative of Principles of Natural Justice and consequently direct the Respondent Police not to interfere and not to meddle with the civil disputes existing between the Petitioners and third parties in respect to aforesaid suit schedule property and not to harass the petitioners and to pass s IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents and consequently direct the Respondent Police not to interfere and not to meddle with the civil disputes existing between the Petitioners and third parties in respect to aforesaid suit schedule property and not to harass the petitioners which is subject matter of civil suit in Principal Civil Judge (Senior Division) at Srikakulam pending disposal of the above writ petition and to pass Counsel for the Petitioner(S):

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS to declare action of the Respondent Police in interfering and meddling with civil disputes which was exists between Petitioner and parties in respect to mortgaged property which is subject matter property of suit in O.S.NO.81 of 2024 third on the file of the Principal Civil Judge (Senior Division) at Srikakulam and the police are every day calling pressurize the Petitioners the petitioners to police station and to compromise civil disputes with dire consequences despite pendency of suit before the competent civil court which sub-judice highly illegal, arbitrary, unjust and unconstitutional and violative of Articles 300-A, 14, 21 of the Constitution of India and violative of Principles of Natural Justice and consequently direct the Respondent Police not to interfere and not to meddle with the civil disputes existing between the Petitioners and third parties in respect to aforesaid suit schedule property and not to harass the petitioners and to pass such other order or orders…”
2. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home representing the respondents.

Learned counsel for the petitioners would submit that the police are interfering in the civil disputes.

Learned Assistant Government Pleader, on written instructions, would submit that basing on the complaint made by the victim, the Police called the petitioners to the Police Station though the dispute is civil in nature. Learned Assistant Government Pleader further would submit that the Police are not interfering in the civil matter and appropriate orders may be passed.

5. Considering the submissions, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil dispute. There shall be no
order as to costs.
