YALLABANDI RAMATIRTHA Counsel for the Respondent(S): 1.GP FOR HOME (AP) 2.VINOD KUMAR TARLADA The Court made the following: 2 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.18376 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….issue a writ order or direction more particularly one in the nature of writ of Mandamus declaring the high handed action of the respondents 3 and 4 with active influence of the 5th respondent in contemplating to evict the petitioner from the vacant site purchased by the petitioner by way of sale deed dt.6.8.2010 in an extent of 105 sq yards situated at R.S.No.324/3 of Udayapuram Village, Rajamma Veedhi, 21st ward, Palasa, Kasibugga Municipality at D.No.21.2.646 more so when the civil litigation in A.S.No.16/19 on the file of Addl. District Judge, Sompet, Srikakulam District is pending as illegal, arbitrary and capricious and to pass …” 2. Heard Sri Yallabandi Ramatirtha, learned counsel for the writ petitioner, learned counsel for the unofficial respondent and learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home on written instructions would submit that the impugned dispute in the writ petition is of civil in nature. Therefore, police will not interfere in the matter. 4. This Court cannot go into the merits of the civil dispute under Article 226 of Constitution of India. It shall be decided only by the competent Civil Court. 5. Considering the above facts and circumstances and in the light of submissions made by the learned Assistant Government Pleader for Home, this Court is of the considered opinion that the writ petition can 3 be closed at the stage of admission, without going into merits of the case. 6. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
