Heard Mr. A. Ahmed, the learned counsel for the petitioner and also heard Mr. R.J. Baruah, the learned Additional Public Prosecutor appearing on behalf of

This is an application under Section 482 of BNSS, 2023, have been filed by the petitioners, namely, Shyamal Mitra, seeking pre-arrest bail in connection with PRC Case No.509/2025 under Section 10(2)/111(2)/310(2)/254/317(3) of the BNS, 2023, arising out of Jagiroad P.S. case No. 249/2024, pending before the Court of learned JMFC-II, Morigaon. 3. As per the FIR, a truck belonging to Bikaner Assam Roadlines India Ltd. was carrying a cargo of 32,900 kgs dried betel nut through Hojai towards Guwahati and on 26.12.2024 at about 10:30 p.m. near Sitajokhola Deuhal, some unknown miscreants pulled out the driver and the co-driver of the vehicle carrying the said cargo and subsequently the vehicle was recovered without its cargo of betel nut. 4. It appears from Page No.18, Annexure-3, police report that it was the present petitioner who informed the police about his purchase of a part of the betel nut cargo from one Najimuddin, which was subsequently seized by the police from the present petitioner. 5. As the charge-sheet has been submitted in this case, the scanned TCR was been called for and the same has been received and I have perused the relevant portions. 6. The present petitioner has also been sent up for trial in the charge-sheet and the learned Court below in PRC No. 509/2025 has also taken cognizance and issued summons and the next date is stated to be fixed on 19.12.2025. 7. In view of the completion of investigation and also some co-operation rendered by the petitioner during investigation, there is no reason to cancel the interim bail.
Accordingly, the same is hereby made absolute, subject, of
Page No.# 3/3 course, to the following conditions:- (i) he shall appear before the learned Court below on the next date fixed and also be available during the trial, if once commences, (ii) he shall not hamper or tamper with the evidence. (iii) That the accused person shall not misuse his liberty to commit any offences or any illegal activities,
8. Violation of any bail condition will entail cancellation of the bail. 9. Accordingly, this instant interlocutory bail application stands allowed and disposed of. 10. Send back the case diary. JUDGE Comparing Assistant
