GP FOR CIVIL SUPPLIES The Court made the following: 3 THE HONOURABLE SRI JUSTICE T.C.D.SEKHAR WRIT PETITION NO. 18795 of 2025 ORDER: The petitioner is fair price shop dealer of shop No.1228032 of Garugu Chintalapalli Village, Putlur Mandal, Ananthapuram District. It is further case of the petitioner that she is distributing the essential commodities to the cardholders without therebeing any complaints from anybody and to the utmost satisfaction of the respondent authorities. While so, on 05.06.2025, inspection was conducted in the fair price shop of the petitioner and found certain variations in stock and thereafter a show cause notice dated 02.07.2025 was issued to her asking to submit explanation as to why her authorization shall not be cancelled. The petitioner claims that she has submitted explanation. It is further case of the petitioner that without passing orders on the explanation submitted by her, the respondents stopped supplying essential commodities. 2. On the other hand, the learned Assistant Government Pleader for Civil Supplies placed instructions dated 22.07.2025 furnished by the 2nd respondent. On perusal of the said instructions, it is clear that pursuant to the show cause notice dated 02.07.2025, the petitioner submitted explanation and the same is under consideration. The said instructions are placed on record. 4 3. Therefore, without passing any order of suspension or cancellation against the petitioner, the respondents cannot stop supply the essential commodities to the petitioner’s fair price shop. 4. Having regard to the facts and circumstances of the case, the present Writ Petition is disposed of directing the respondents to supply the essential commodities to the petitioner’s fair price shop forthwith. This order will not preclude the respondent authorities from passing of appropriate orders pursuant to the show cause notice dated 02.07.2025 in accordance with law. There shall be no order as to costs.
