Captioned MC has been filed with a condonation of delay (CoD) prayer. [2]
The prayer reads as follows :-
“In view of the above stated facts, it is respectfully prayed that this Hon’ble Court be pleased to: - i. Condone the period from 22.06.2024 to 20.11.2024, may be condoned in computing the statutory period of 30 days in preferring the above referred Appeal against the Impugned Orders dated 23rd May, 2024 passed by the Hon’ble High Court of Manipur in Writ Petition (C) No. 701 of 2023 and hear the matter on merit;
ii. Pass such further order or orders or directions which this Hon’ble Court deem fit and proper for the ends of justice. This Court is of the considered view that the prayer is not happily worded and therefore, we deemed it appropriate to advert to an undisputed tabulation in the CoD MC which reads as follows :
“Table below for easy reference:
A. Days taken from the date of the judgment 183 days B. Permissible Time for Appeal 30 days C. Time taken in obtaining Certified copy 4 days
Actual delay in filing the Appeal [A – (B)]: 153 days

Therefore, captioned MC is one seeking condonation of 153 days delay in filing an intra court appeal. [5]
The reasons buttressing the CoD prayer primarily turn on time consumed in the process of preferring an appeal owing to procedural requirement qua state machinery. [6]
In the light of the reasons, respondents’ counsel fairly submitted that the CoD prayer is not opposed. This means that we would not dilate more either on the reasons or on any other aspect of the matter. [7]
Sequitur is, captioned MC ordered as prayed for. Delay condoned. There shall be no order as to costs.
