ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:-
“..to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in attempting to construct guest house in part of petitioners land of 46 cents in Sy.No.28/1 Alladupalle Village, Chapadu Mandal, YSR District without acquiring the same
under The Right to Fair Compensation Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 as illegal, unjust, arbitrary and against statutory provisions and consequently direct the respondents not to make any construction in part of petitioners land of 46 cents in Sy.No.28/1 Alladupalle Village, Chapadu Mandal, YSR District and pass such other order or orders as this Honble High Court may deem fit and proper in the circumstances of the case....”
2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Endowments appearing for the respondents.
3. During hearing, learned counsel for the petitioner submits that this Court on 28.03.2016 passed an interim order and requests to make the said interim order as absolute. The interim order granted by this Court on 28.03.2016 reads as follows:-
“W.P.No.9739 of 2016
Rule Nisi. Call for records.
Notice returnable in four weeks. I.A.No.02 of 2016
There shall be interim direction as prayed for”.
4. Learned Government Pleader for Endowments appearing for the respondents opposed for grant of any relief in this Writ Petition and prayed to dismiss the same.
5. In view of the request made by learned counsel for the petitioner, this Court deems it fit to dispose of the writ petition by making the interim
order dated 28.03.2016 as absolute.
6. Accordingly, this Writ Petition is disposed of while making the interim order granted by this Court, dated 28.03.2016 as absolute, directing respondents not to make any construction in part of petitioners’ land of 46 cents in Sy.No.28/1 Alladupalle Village, Chapadu Mandal, YSR District. If at all the respondents intend to take steps against the petitioner with regard to the subject property, they are directed to follow due process of law. Till then, the respondents are directed not to take any coercive steps against the petitioner with regard to the subject property. There shall be no order as to costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
