JUSTICE HARISH KUMAR ORAL ORDER 2 27-06-2025 Heard the parties. 2. The petitioner is apprehending his arrest in connection with Shampur P.S. Case No. 63 of 2024 registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379, 354, 427, 504, 448/34 of the Indian Penal Code and Section 27 of the Arms Act. 3. The prosecution alleges that on account some trifle, all the F.I.R. named accused persons, including the petitioner, armed with Lathi, Danda and other weapons, came there and started abusing and assaulting. It is specifically alleged that the petitioner along with other co-accused brutally assaulted the informant and when the family members of the informant came there to his rescue, the accused persons, including the petitioner, also assaulted them. Learned Advocate for the petitioner contended that the narrations made in the F.I.R. clearly suggests general and omnibus nature of allegations against all the F.I.R. named accused persons. So far the injuries sustained to the informant and other two persons are concerned, the same appear to be simple in nature. It is further contended that the petitioner is a man of fair antecedent and moreover two co-accused persons, facing identical allegation, have been allowed the privilege of anticipatory bail by this Court in Cr. Misc. No. 81208 of 2024 vide order dated 04.12.2024. 5. On the other hand, learned APP for the State vehemently opposes the bail application and submits that the petitioner has actively participated in the crime and there is allegation of assault and snatching the valuables. 6.
Considering the submissions set forth by the learned Advocate for the parties, inter alia, the omnibus nature of allegation against all the F.I.R. named accused persons, coupled with the simple injuries sustained to the informant and others, apart from the case of the petitioner based on parity and the fair antecedent, let the petitioner, named above, in the event of his arrest or surrender before the court

No.17074 of 2025(2) dt.27-06-2025 3/3 below within four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Shampur P.S. Case No. 63 of 2024, subject to the condition as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close relative of the petitioner. uday/- (Harish Kumar, J) U T
