This Writ Petition under Article 226 of the Constitution of India is filed for the following relief:
“to issue appropriate Writ or any other order or direction particularly one in the nature of Writ of Mandamus to declare the action of the respondents in passing resolution dated 22.07.2016 by denying the petitioners salaries from the date of attaining the age of 58 years

till the date of retirement of age 60 years and threatening the petitioners not to approach this Honble Court as highly illegal arbitrary and unconstitutional and set aside the same consequently direct the respondents to pay arrears of salaries from the date of attaining the age of 58 years till the date of petitioners re induction into service and to pass...”

The main grievance of the writ petitioners is that they are employees of the 3rd respondent/Bank, and they sought a direction from this Court to allow them to continue in service until they attain the age of 60 years. 3. Today, when the matter is called, there is no representation on behalf of the petitioners. 4. Learned Standing Counsel for the respondent No.3/Bank submits that, in view of the administrative decision taken by the respondent No.3/Bank, all the petitioners were permitted to continue in service until they attained the age of 60 years. Consequently, upon attaining the said age, they were duly superannuated and have received all retirement benefits. In support of his submission, the learned standing counsel placed before this Court a note issued by the Chief Executive Officer, District Cooperative Central Bank Limited, Eluru, wherein the relevant tabular data is extracted hereunder: S.No.

A plain reading of the aforementioned proceedings goes to show that the petitioners were retired from service on attaining the age of 60 years and were also received all retirement benefits by the 3rd respondent/Bank. The above note proceedings made as part of the record. Therefore, the cause in the writ petition does not survive for further adjudication. 6. In these circumstances, this Court is of the view that merely keeping the writ petition pending would yield no useful purpose. Therefore, the writ petition is closed. 7. However, this order will not preclude the petitioners from taking recourse to law as permissible, if so advised. There shall be no order as to costs.
