B PRAKASAM (Sr SC FOR A M C ) The Court made the following: COMMON ORDER: Writ Petition No.8785 of 2018 is filed under Article 226 of Constitution of India with the following prayer for: “.... a writ of Mandamus, declaring the action of the respondents herein in not considering the representations dated 05-02-2018 and 14-02-2018 made by the petitioner for continuing the petitioner into the post of at-tender is being illegal, arbitrary, unreasonable, discrimination and violative f Article 14 and 16 of Constitution of India and violation of principles of Natural justice and consequently direct the respondents 2 to 6 herein to consider and dispose of the representations dated 05-02-2018 and 14-02-2018 made by the petitioner.” Contempt Case No.1268 of 2018 is filed by the Petitioner to punish the Respondents 1 and 2 herein for willful disobedience of the orders dated 16.03.2018 passed by the Hon'ble Court in IA No.1 of 2018 in WP.NO. 8785 of 2018 under Section 10 to 12 of the Contempt of Courts Act 2. When these matters are taken up for hearing, Sri B.Prakasam, learned Standing Counsel for Respondent Nos.4 to 6 in the above writ petition would submit that the representations of the Petitioner have been considered and were rejected. Hence, no further orders are required in these matters and the petitions may be disposed of. 3 3. Sri Koppula Gopal, learned counsel for the Petitioner would submit that the Court may pass appropriate orders by giving liberty to the Petitioner to challenge the rejection order. 4. In that view, the Writ Petition is disposed of and consequently the Contempt Case is closed. However, the Petitioner is at liberty to challenge the rejection order, if so advised. There shall be no order as to costs.
