This anticipatory bail application under Section 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been preferred by the petitioner apprehending his arrest for offences registered under Sections 379, 411 of the Indian Penal Code in connection with Gopikandar P.S. Case No. 38 of 2023 pending in the Court of learned Judicial Magistrate, 1st Class, Dumka. 3. It is alleged that the petitioners and others were stealing iron channels when the motorcycle was intercepted and this petitioner managed to flee. One of his associate namely Safikul Sheikh was arrested from the spot who disclose that this petitioner was one of the accused. 4. During course of argument, learned A.P.P. for the State submits that the petitioner is not cooperating with the investigation as the notices under Section 41-A of Cr.P.C. has not been complied with. 5. Considering the fact that this petitioner fled from the place of occurrence when intercepted while he was stealing iron 2025:JHHC:15791 2 channels and he was not cooperating with the investigation, this Anticipatory Bail Application stands dismissed.
