1. Heard Shri Ajay Shrivastava, learned counsel for the petitioner and Ms. Poorva Tiwari, learned Panel Lawyer for the State.
2. Instant petition has been filed seeking following reliefs:-
“(i)That, this Hon’ble Court may kindly be pleased to quash the impugned order dated 17/01/2023 (Annexure P-1) and further GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.02.03 11:45:26 +0530
2 may be pleased to direct the respondent authorities to grant salary, allowances and other benefits of the suspension period with all consequential benefit with 18% interest, in the interest of justice. (ii)Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.”

Learned counsel for the petitioner submits that since minor punishment has been imposed upon the petitioner, as such the petitioner is entitled to get entire salary for the period when he was suspended. He has placed reliance upon a order placed by the coordinate bench of this court in WPS No. 5203/2020 in between Arvindra Kumar Koshti Vs. State of Chhattisgarh & ors. in which reliance is placed upon the judgement passed by the Supreme Court reported in 2004 (1) MPHT 22 in between Y.S. Sachan Vs. The State of Madhya Pradesh and others as also the circular of the State Government dated 23/11/2010.
4. Considering the aforesaid aspect of the matter, since minor punishment has been imposed upon the petitioner which has not been disputed by the State counsel, this petition is allowed. The petitioner is entitled to get entire salary for the period when he was suspended. Sd/-
