This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail to the applicant who has been arrested in connection with Crime No.79/2025 registered at Police Station – Cyber Range Raipur, District – Raipur (C.G.), for the offence punishable under Sections VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.07.02 19:09:13 +0530
2 317(2), 317(4), 317(5), 111 and Section 3(5) of BNS, 2023. 2. Case of the prosecution, in brief, is that in one of the Karnataka Bank, Raipur, the applicant has applied for personal loan. The applicant/accused had given a photocopy of his account number when asked for loan facility, on which the applicant/accused was assured that the loan will be granted and the money will come in the account. It was also said that the interest on the loan will be 7%. The applicant/accused did not know that the cyber thugs put the loan in his account by making a tempting promise of loan. Thinking that the amount which came in the account of the applicant/accused is only a loan, the applicant/accused remained quiet. Presently, when the cyber thug was caught, he gave a photocopy of his statement. 3. According to this, the applicant/accused's account number has been given and the amount has been transferred, which is approximately Rs. 1,85,000/-. In the name of giving loan to the said applicant/accused, Rs. 15,000/- has already been deducted from the loan amount of Rs. 2,00,000/-, on which the applicant/accused was operating the account with his trust. The applicant/accused is unaware that the loan has not been given by transferring money to his account by cheating through cyber, but theft has been committed, which was known to the cyber police station when the applicant/accused was caught. 4.
Learned counsel for the applicant submits that the present
3 applicant has been falsely implicated in this case. He submits that the applicant has no nexus with the aforesaid act. He further submits that upon investigation by the police against the applicant, no ingredients of Section 111 of BNS 2023 is established and the applicant has been arrested solely on the basis of suspicion. He further submits that applicant is in jail since 27.03.2025 and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 5. On the other hand, learned State counsel opposes the bail application. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Considering the facts and circumstances of the case, nature and gravity of the offence and further the fact that the applicant has been involved in the online Cyber fraud and has received money on his account and despite knowing the same, he has not disclosed the same to any one, therefore, it is not a fit case for grant of bail to the applicant. 8. Accordingly, the bail application of the applicant – Manish Dodwani involved in Crime No.79/2025 registered at Police Station – Cyber Range Raipur, District – Raipur (C.G.), for the offence punishable under Sections 317(2), 317(4), 317(5), 111 and Section 3(5) of BNS, 2023, is rejected. 9. Needless to say that the trial Court concerned is at liberty to
4 proceed and conclude the trial expeditiously. 10. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
