VENKATESWARLU NIMMAGADDA THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No. 17319 of 2016 ORDER: The present Writ Petition is filed for the following relief: “to issue Writ Order or Direction more particularly one in the nature of Writ of Mandamus by declaring the action of the 2nd Respondent Municipality in accepting the tenders of the Respondent Nos.4 to 6 for the Tenders called for vide Roc.No.99- 2016-E1, dt.9.5.2016 in Mandapeta Municipality, East Godavari District as illegal, arbitrary and further direct the respondents to declare that the Respondent Nos.4 to 6 are ineligible for participation in the tenders in view of Sub Rule 2 of Rule 5 of A.P. Municipalities Tender Rules 1967 and to pass….” 2. When the matter is taken up for hearing, learned counsel for the Petitioner represented that cause of action in the Writ Petition does not survive and as such, no further orders are necessary in this Writ Petition. 3. Recording the said submission, the Writ Petition and other miscellaneous petitions, if any, are therefore dismissed as infructuous.
