The petitioners are apprehending their arrest in connection with Complaint Case No.44 of 2021, for offence registered under section 33(c) of Indian Forest Act, pending in court of learned Sub Divisional Judicial Magistrate, Chatra. 3. Learned counsel for petitioners submits that false allegations are there of cultivation of poppy plant in the forest land, however, the petitioners have nothing to do with the same and even the land is not of the petitioners. He then submits that the petitioners have got no criminal antecedent as disclosed in paragraph no.17 of the petition. 4. Learned State counsel opposes the prayer and submits that allegations ae there of cultivation of poppy plant in forest land. 5. Considering that petitioners have got no criminal antecedent as aforesaid, and even the land is said to be of forest department and -2- A.B.A. No. 5719 of 2025 allegations are made of cultivation of poppy plant, I am inclined to grant anticipatory bail to petitioners. 6. Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Sub Divisional Judicial Magistrate, Chatra, in connection with Complaint Case No.44 of 2021, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
