This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 44/2025 registered at Police Station – Civil Line, District – Raipur (C.G.) for the offence punishable under Section 317(2), 317(4), 317(5),111,3(5) of BNS. 2. As per prosecution story in brief is that on 20/01/2025, through the portal of the Ministry of Home Affairs, Government VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.06.24 10:28:04 +0530 2 of India, information was received at Police Station Civil Lines, Raipur, regarding the operation of mule bank accounts in Utkarsh Small Finance Bank. Upon inquiry, it was found that 104 such mule accounts had been fraudulently opened and were allegedly used for committing cyber fraud amounting to ₹36,48,448/-. Based on this information the offence has been registered on 20/01/2025 and during investigation on the basis of the memorandum statement of the co-accused Mehul Vij the present accused has been arrested on 04/02/2025. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He submits that the applicant is not an agent or employee of any bank and runs a cycle store located ar Birgaon, Raipur and no connection with the co-accused. He has been arrested only on the basis of memorandum statement of the co-accused. He also submits that the applicant has not opened any bank account nor assisted in opening any account in the name of the co-accused or any other person, and no account has been found in the applicant’s name. He further submits that applicant has two pending criminal case against him bearing crime No.204 of 2022 offence under Section 294, 323, 506-B & 34 and Crime No. 219 of 2022 offence under Section 307, 34 of IPC & 25, 27 Arms Act. He also submits that the present applicant is in jail since 04.02.2025 and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 3 4. On the other hand, learned State counsel, opposes the bail application and submits that the present case is of the nature of online fraud, by which the complainants suffered of huge amount. He also submits that applicant has two pending criminal case against him bearing crime No.204 of 2022 offence under Section 294, 323, 506-B & 34 and Crime No. 219 of 2022 offence under Section 307, 34 of IPC & 25, 27 Arms Act.therefore, the present applicant is a habitual offender and he is not entitled for grant of regular bail. Thus, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, submissions of learned counsel for the parties, nature of dispute and material available in the case diary, it transpires that the present case is of the nature of online fraud, by which the complainants suffered loss of huge amount and applicant has two pending criminal case against him bearing crime No.204 of 2022 offence under Section 294, 323, 506-B & 34 and Crime No. 219 of 2022 offence under Section 307, 34 of IPC & 25, 27 Arms Act, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on bail. 7. Accordingly, this second bail application of applicant – Harmeet Singh @ Yashmit involved in Crime No. 44/2025 registered at Police Station – Civil Line, District – Raipur (C.G.) for the 4 offence punishable under Section317(2), 317(4), 317(5),111,3(5) of BNS, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
