The appellant, Oriental Insurance Company Limited, is represented by its duly authorized officials, namely, Mr. R. K. K. Sinha, Regional Manager, and R. C. Pathak, Manager. The claimant, namely, Mariyam Bibi, is present in person along with her engaged counsel, Mr. M. Khan. It is submitted that the total awarded amount is Rs. 3,55,000/- (Rupees three lakhs fifty five thousand) only. After negotiation, both the parties have mutually agreed to settle the matter for a sum of Rs. 3,50,000/- (Rupees three lakhs fifty thousand) only, out of which Rs. 1,77,500/- (Rupees one lakh seventy-seven thousand five hundred) only has already been paid and a balance amount of Rs. 1,72,500/- (Rupees one lakh seventy two thousand five hundred) only is agreed upon as a full and final settlement of the claim. Accordingly, the appellant/Oriental Insurance Company Ltd. is hereby directed to deposit the amount of Rs. 1,72,500/- (Rupees one lakh seventy two thousand five hundred) only before the Registry of this Court within 1 (one) month from the date of the order and the claimant, namely, Mariyam Bibi, is permitted to withdraw the same on being proper verification and identification. Page No.# 6/6 Registry to refund the statutory deposit of Rs. 25,000/- (Rupees twenty five thousand) only to the appellant/Insurance Company.
