The learned senior counsel, Mr. M. Rarry appearing for the applicant before this Court physically in the proceeding of MC[W.P.(C)] No. 426 of 2025 whereby seeking for some appropriate direction relating to issuance of process through paper publication, keeping in view of the provision of Order 5 Rule 21(A) of CPC. However, learned counsel for the respondent, Mr. K. Kishan appearing before this Court physically in the proceeding of MC[W.P.(C)] No. 426 of 2025, is submitting that the process may be taken through paper publication i.e. in local newspapers, and the same has also been taken on record for proper service of process. The learned senior counsel, in this matter, is seeking appropriate process through paper publication against the respondents No. 3 to 127 in W.P.(C) No. 611 of 2024 keeping in view of the provision of Order 5 Rule 21(A) of CPC. However, the learned senior counsel in this miscellaneous case proceeding is seeking consideration of the written statement of the aforesaid application as filed under the provision of Order 5 Rule 21(A) of CPC. However, in the reasons stated in the aforesaid proceeding and also requirement for appropriate service of process against the respondents are concerned, it is deemed appropriate that the proceeding in MC[W.P.(C)] No. 426 of 2025 is hereby considered in the interest of justice and consequent upon the consideration of the said proceeding, it is deemed appropriate that the writ petitioner in W.P.(C) No. 611 of 2024 be directed to take an appropriate process against the respondents No. 3 to 127, keeping in view of the provision of Order 5 Rule 21 (A) of the CPC for wider publication with the proper particulars.
However, keeping in view of the given peculiar facts and circumstances of these cases are concerned, it is deemed appropriate that the petitioner be directed to take an appropriate process, keeping in view of Order 5 Rule 21 (A) of CPC for wider paper publication and issuance of notice against the respondents No. 3 to 127 in W.P.(C) No. 611 of 2025 on 05.07.2025 through paper publication in “The Times of India” and “The Hindu”.
